Eligibility/Entries: The Kohls.com Present Perfect Sweepstakes is open to persons who are at least eighteen (18) years of age at the time of entry and a legal resident of the fifty (50) United States or the District of Columbia. Employees of Kohl’s Department Stores, Inc. (the “Sponsor”), its subsidiaries, affiliates, sales representatives, distributors, advertising and promotion agencies, and members of each of their immediate families (spouses, parents, grandparents, children and siblings, and their respective spouses) and those living in the same household of each are not eligible. Participation in the Sweepstakes constitutes entrant’s full and unconditional agreement to, and acceptance of these Official Rules. Winning a prize is contingent upon fulfilling all requirements set forth herein. Sweepstakes begins at 12:00:00 AM ET on November 1, 2008, and ends online at 11:59:59 PM ET on December 28, 2008 (the “Sweepstakes Period”). To enter, go to http://www.kohls.com/sweepstakes, during the Sweepstakes period, click on the Kohl’s Present Perfect Holiday Sweepstakes link and complete the registration form by entering your name, street address, city, state, ZIP code, e-mail address and daytime phone number. In order for the electronic entry to be valid, entrants must click on the “Submit” button on the Web site. Entrants must provide a valid e-mail address to enter online. In the event of a dispute as to any entry, entries will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry. “Authorized account holder” is defined as the natural person who is assigned to the e-mail address by an Internet access provider, online service provider, or other organization (e.g. business, educational institution, etc.) which is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Proof of being the authorized account holder may be required. Online entries must be submitted by 11:59:59 PM ET each day to be eligible for the daily drawings and by 11:59:59 PM ET on December 28, 2008, for the Grand and First Prize drawings. Limit one online entry per valid e-mail address. To enter via mail hand print your name, complete address and daytime and evening phone number on an approximately 3 x 5 card or paper and mail it in an envelope to Kohl’s Present Perfect Sweepstakes, P.O.Box 709, Bayonne, New Jersey 07002. To be eligible, each mail in entry must be mailed in a separate envelope, and be postmarked by December 28, 2008 and received by January 8, 2009. All entries become the property of the Sponsor and will not be acknowledged or returned. No photocopied or mechanically produced entries allowed. Sponsor not responsible for lost, late, illegible or postage-due entries. Mail in entries will be eligible for the daily drawings throughout the Promotion period.2. Random Drawing: One (1) Grand and one (1) First Prize winner will be selected from among all entries received during the Sweepstakes period on or about January 12, 2009. Ten (10) Daily Prize winners will be selected in a random drawing from all eligible entries received each day during the sweepstakes period. The drawings will be conducted by The Contest Factory, the judges of this Sweepstakes, whose decisions are final and binding on all matters relating to this Sweepstakes. Grand and First Prize winners will be notified by phone and/or certified overnight mail on or about January 13, 2009. 3. Prizes/Odds: Grand Prize (1 winner total): $10,000 cash. ARV. $10,000. First Prize (1 winner total): Family vacation for four to Orlando, Florida to include coach air, hotel for 4 days and 3 nights double occupancy, $1000 spending money, $500 Kohl’s Gift Card, four tickets, plus a behind the scenes tour to La Nouba from Cirque du Soleil at Walt Disney World Resort, and tickets to select parks, attractions and shows. ARV. $5,000. Daily Prizes (10 winners each day – 580 total): $50 Kohl’s Gift Card. ARV. $50 each. Total value of all prizes is $44,000. Odds of winning depend upon the total number of entries received. 4. Limitations of Liability: Sponsor and its agents are not responsible for any incorrect or inaccurate information, whether caused by entrants, printing errors, or by any of the equipment or programming associated with or utilized in the Sweepstakes. Any computer, online, telephone or technical malfunctions, delays or human errors that occur in the processing, transmission or receipt of entries, or for inaccurate transcription of entry information, or for entries that are stolen, misdirected, garbled, lost or delayed by computer transmissions or any injury or damage to persons or property, including but not limited to entrants’ computers, hardware and/or software, which may be caused directly, or indirectly, in whole or in part, from entrants’ participation in the Sweepstakes or receipt, redemption or use of any prize. If, for any reason, the Sweepstakes is not capable of being conducted as planned, including but not limited to infection by computer viruses, bugs, tampering, unauthorized intervention, fraud, technical failures, or other causes beyond the control of Sponsor, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes. Sponsor also reserves the right, in its sole discretion to disqualify any individual found to be violating these Official Rules or suspected of attempting to disrupt or defraud the entry process or the operation of the Sweepstakes, and Sponsor may prosecute or seek other legal redress against anyone suspected of engaging in these acts. 5. Prize Acceptance: Prizes are not transferable or assignable. No substitution or cash redemption allowed except by Sponsor, who may substitute a prize of equal or greater value if advertised prizes become unavailable. All taxes, including federal, state and local taxes, are the sole responsibility of winners who may be issued an IRS 1099 tax form (winners are advised to seek independent counsel regarding prize winnings). The Grand and First Prize winners will be required to sign and return an Affidavit of Eligibility/Release of Liability and Publicity (where permitted) within fourteen (14) days of notification. If a potential winner cannot be contacted within fourteen (14) days after the first attempt to contact the potential winner, if the potential winner does not sign and return the Affidavit of Eligibility/Release of Liability and Publicity (where permitted) in the required time period, or if a prize is returned as undeliverable, the prize will be deemed forfeited and an alternate winner will be selected from among all remaining eligible entries received. By accepting prizes, winners consent to use of name, state of residence and likeness for advertising and promotional purposes online and in print, or in any other media worldwide in connection with the Sweepstakes, without limitation and without additional compensation worldwide, except where prohibited by law. By accepting prizes, winners further agree to release Sponsor and its subsidiaries, affiliates and related companies and each of their respective officers, directors, employees and agents, including but not limited to The Contest Factory (the “Sweepstakes Parties”), from any and all liability, loss or damage of any kind arising out of or in connection with winners’ participation in this Sweepstakes, or with respect to the awarding, receipt, possession, use and/or misuse of any prize. 6. Entrant’s Personal Information: Information collected from entrants online are subject to Sponsor’s privacy policy. In addition to any prize notifications, Sponsor may use an online entrant’s name, address, e-mail address for future promotional and marketing purposes in accordance with its privacy policy. 7.
